Stukes, Justice.
The defendant insurance company, appellant here, issued its policy of collision insurance dated June 16, 1947, covering- respondent’s Buick passenger car whereby it insured respondent against loss from collision or upset to the extent of the actual cash value of the car. Respondent paid the annual premium of $81.00. On the following November 22d there was a collision between the automobile and a truck of Southern Cotton Oil Company wherein the car was demolished and respondent received very serious personal injuries.
