RULING ON DEFENDANT’S MOTION FOR SUMMARY JUDGMENT

ZAMPANO, District Judge.

This action was commenced to collect the proceeds of two insurance contracts issued by the defendant on the life of Walter E. Lewis, plaintiff’s deceased husband. The defendant now moves for summary judgment. Rule 56, Fed.R.Civ.P.

For the purposes of this motion, the following facts are deemed pertinent and undisputed. On July 1, 1971 and again on June 10, 1972, the defendant issued an insurance policy in the amount of $15,000 on Mr. Lewis’ life. Eight days after the issuance of the second policy, Mr. Lewis was killed…
