Appellees filed the bill in this case in the circuit court of Clinton county for the partition of 393i acres of land, claiming title in fee simple in themselves and Ellen Mc-Kenna, who was made a defendant, as tenants in common under the will of' Owen Mulligan, deceased, and asking to have certain deeds and a .mortgage declared null and void,-as clouds upon the title.
