STAKELY, Justice.

This is an appeal from a decree of the equity court overruling the demurrer of the respondents to the original bill of complaint as a whole and to each and every aspect thereof.

The allegations of the bill of complaint which was filed June 16, 1960, in substance, show the following. Complainant Charles Fauché, also known as Larry Foshee (appellee), is the grandson of Julian C. Ford, deceased, and Gussie Ford, deceased, and is the sole surviving heir of Gussie Ford, deceased. Prior to January 16, 1899, Gussie Ford was the owner in fee simple of the lands involved in this suit.…
