This is a suit for an accounting and to recover the balance of premium claimed to be due the North Dakota workmen's compensation fund from defendants C.M. Padgett and the Padgett Company. The Northern Trust Company is made defendant because it was surety on the bond of the Padgett Company and C.M. Padgett, contractors, hereinafter referred to as the contractor. The Northern Trust Company demurred on the ground that the complaint does not state facts sufficient to constitute a cause of action against the surety.
