Plaintiff brought this action for damages, and for an injunction to restrain der fendant from maintaining a dam, with an alternate prayer for additional damages in the event the injunction is denied.
About the year 1923, plaintiff and his brother Claude Hurley became owners as tenants in common of certain tracts of land located in or along the Nolichucky River, between Hamblen County and Cocke County, Tennessee.
