The proof offered on the part of the plaintiff tended to establish the following facts: Rudolph Nicholas, the deceased, aged a few days less than 15 years, and four other boys were riding on bicycles, going east, in single file, on a path in the dirt shoulder along the southerly side of the concrete paving on the Nine-mile road near Gratiot avenue, in the city of Detroit, on the evening of August 1, 1924.
