This is an appeal by the plaintiff from a judgment rendered in favor of the defendant on a directed verdict in an action to recover damages for personal injuries.

From the record in the case it appears that Catherine G. Branan, a minor, 12% years of age, while playing attempted with other Children to climb to the 4op of a pile of lumber in the lumber yard of William A. Wimsatt. During the struggle of the children to reach the top of the pile 28 boards were displaced and fell on Catherine, with the result that her right thigh was broken, thereby causing a…
