The defendant was convicted of murder in the first degree in the killing, by assaulting and beating, of Roger Brown on August 11, 1949, in an area known as Washington Park in the Roxbury district of Boston. The jury recommended that the sentence of death be not imposed, and the defendant was sentenced to life imprisonment. G. L. (Ter. Ed.) c. 265, § 2, as appearing in St. 1951, c. 203. The case is here on appeal under G. L. (Ter. Ed.) c. 278, §§ 33A-33G, as amended.
