On March 13,2008, the U.S. Department of State appointed Matthew Nasuti to a one-year, excepted-service position as a Senior Management Advisor in the Iraq Transition Assistance Office. Just two weeks later, on March 28, 2008, the State Department terminated Mr. Nasuti’s appointment “for operational reasons.” Mr. Nasuti appealed to the Merit Systems Protection Board, alleging that his termination violated the Whistleblower Protection Act, 5 U.S.C. § 2302(b)(8).
