Matthew J. Nasuti petitions for review of two final decisions of the Merit Systems Protection Board (“Board”). The Board dismissed Nasuti’s individual right of action (“IRA”) appeal for lack of jurisdiction. Nasuti v. Dep’t of State, No. DC-1221-12-0321-W-1 (M.S.P.B. May 31, 2012) (“IRA Decision II”). The Board also dismissed Nasuti’s adverse action appeal and his claim for back pay under 5 U.S.C. § 5596 for lack of jurisdiction. Nasuti v. Dep’t of State, No. DC-0752-12-0370-1-1 (M.S.P.B.
