Pending before the Court is the Defendant’s Motion for Summary Judgment and the Plaintiff’s Cross-Motion for Summary Judgment, filed pursuant to Rule 56 of the Federal Rules of Civil Procedure. The Plaintiff brought this action under Section 205(g) of the Social Security Act, 42 U.S.C. § 405(g) (1976), seeking judicial review of a final decision of the Secretary of Health and Human Services.
