[1 ] The appellee Lynn presents a motion to dismiss this appeal because appellant has not filed an appeal bond, or affidavit in lieu thereof, as required by the .statute. The judgment from which appeal is sought was rendered at a term of the ■district court of Armstrong county, which adjourned the 9th day of October, 1912. An ■affidavit in forma pauperis was made on the 9th day of October, 1912, in lieu of appeal bond. It appears to have been made, signed, .and sworn to before the honorable J. N.
