INTRODUCTION

Debra Beyer was convicted in Dodge County Court of theft of lost or mislaid property under Neb. Rev. Stat. § 28-514 (Reissue 1995). Beyer appealed her conviction to the Dodge County District Court. The district court affirmed Beyer’s conviction. Beyer appeals, claiming the district court erred in determining that § 28-514 is constitutional on its face and as applied, and in determining that there was sufficient evidence to support the county court’s finding of guilt.
