Plaintiff, while employed by defendant, a co-partnershio, as engineer or operator of a drag-line machine, used in handling dirt, on December 28, 1929, in the course of his employment, suffered injury to his right foot, as a result of the beam or boom of the machine, while in motion, jamming the foot against another part of the machine, fracturing some bones, spraining ligaments, and bruising tissue.
