This is an action brought by defendants in error, herein referred to as plaintiffs, against the plaintiff in error, herein referred to as defendant, to recover damages in one cause of action for the removal of certain gravel from the bed of Grand river on land alleged to be owned by plaintiff D. H. Hulbert as riparian owner and upon which plaintiffs Harmon and Mountcastle claimed a lease, under which they claimed the exclusive right to mine and remove the gravel, and in a second cause of action for damages for injuries to the freehold itself by cutting a channel through the gravel bed on the…
