I. INTRODUCTION

In the latest iteration of this longstanding dispute between non-liturgical naval chaplains (“the plaintiffs”) and the United States Navy and various naval officers (“the defendants”), the defendants move the court to reconsider its order denying an appeal of Magistrate Judge Facciola’s ruling that the plaintiffs are entitled to discovery of the deliberations of Selective Early Retirement (“SER”) boards.
