This matter comes before the court on cross motions for summary judgment filed by Plaintiff Precon Development Corporation Inc. (“Precon”) on March 28, 2013, and Defendant United States Army Corps of Engineers (“Corps”) on April 22, 2013. The motions were referred to United States Magistrate Judge Tommy E.
