Appeal from District Court, Smith County; R. W. Simpson, Judge. Action by the Tyler Box & Lumber Manufacturing Company against the ¿Etna Life Insurance Company. From a judgment for plaintiff, defendant appeals.

In its business of manufacturing boxes, baskets, etc., carried on in the city of Tyler, appellee employed a number of persons. To indemnify itself against loss and expense resulting from claims which might be made against it on account of death or bodily injuries accidentally suffered by its employes while engaged in its service, appellee procured of appellant the insurance policy it (appellee) sued on. About 7:30 o’clock p. m. of July 15, 1910, Lester Bell, a boy 13 years of age, while working for appellee about a machine in its factory, had the thumbs of both his hands accidentally cut off.…
