The state appeals from an order sustaining defendant’s demurrer to an information for driving while suspended or revoked. ORS 487.560. The issue presented is whether the information may properly contain an allegation that defendant’s operator’s license had been suspended as a result of a prior conviction for driving under the influence of intoxicants.

"The said defendant, on or about December 3, 1976, in the County of Multnomah, State of Oregon, did unlawfully and with criminal negligence drive a motor vehicle upon a public street or highway during a period…
