Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Albany County) to review a determination of respondent which revoked petitioner’s parole.

In July 1993, petitioner was released on parole after serving approximately four years of a 4 to 12-year prison sentence based upon a conviction in January 1989 of attempted rape in the first degree; as a condition of his parole, petitioner was subject to periodic drug tests.
