Judgment unanimously reversed on the law and petition dismissed. Memorandum: Supreme Court should have converted the petition in this CPLR article 78 proceeding to a petition for a writ of habeas corpus because the sole basis for petitioner’s continued incarceration is the determination of the Parole Board to revoke petitioner’s parole (see, People ex rel. Smith v Mantello, 167 AD2d 912; People ex rel. Saafir v Mantello, 163 AD2d 824).
