Appeal from a judgment of the County Court of Broome County (Mathews, J.), rendered November 20, 1995, upon a verdict convicting defendant of the crimes of sodomy in the first degree (five counts) and aggravated sexual abuse in the first degree.

In December 1994 defendant was indicted on five counts of sodomy in the first degree and two counts of aggravated sexual abuse in the first degree. The indictment alleged, inter alia, that defendant had engaged in five separate acts of deviate sexual intercourse with another person by means of forcible compulsion.
