This is the second appeal in this case. On the first appeal we reversed the judgment directed for John H. Sproule, one of the defendants, and remanded the cause for a new trial. 34 Ill App2d 338, 181 NE2d 379. Sproule is now appealing from the $35,000 judgment entered against him upon the retrial without a jury. Initially plaintiff Sjostrom sued Sproule, who was driving the car in which the plaintiff was riding, John Scott and International Shoe Company, the driver and owner of the car with which the collision occurred on December…
