Defendant was adjudged guilty of grand theft of one star sapphire diamond clip. Trial was by the court, a jury having been waived.
Defendant appeals on the ground that the verdict is contrary to the law and the evidence and that the court erred in certain rulings.
On April 11, 1940, appellant and Franchot Tone, residents of California, were in New York City and appellant, who conducted a jewelry store in California, made a sale of certain jewelry to Tone.
