Plaintiff is the wife of defendant, and brought this action against him to set aside an antenuptial contract on the ground that she was-induced to enter into such contract by fraud and undue influence. This contract provided that in consideration of defendant’s promise-to marry her, and his agreement to pay her $5,000 within a reasonable time after the marriage, plaintiff should be barred and estopped from any claim upon defendant’s estate consequent upon such marriage and her surviving him.
