RULING ON MOTION TO DISMISS

DORSEY, District Judge.

Defendant has moved to dismiss the complaint on the following grounds:(1) the court is without original subject matter jurisdiction over the claim based on Conn.Gen.Stat. §§ 47a-43 through -46;(2) a claim for damage to personal property fails to state a claim upon which relief can be granted; and(3) plaintiffs claim is factually insufficient in that, as a mere agent, plaintiff cannot prove the element of actual possession required in an action for forcible entry and detainer.
