OPINION AND ORDER

DOUMAR, District Judge.

Presently before the Court is the Motion for Summary Judgment filed by Boney Wilson & Sons, Inc., and Hannaford Bros., Co. (collectively, “Hannaford”) and the Motion for Partial Summary Judgment filed by G.D.F., Inc. (“Rite Aid”). For the reasons stated below, Hannaford’s Motion for Summary Judgment will be GRANTED, and Rite Aid’s Motion for Partial Summary Judgment will be DENIED.
