Plaintiff appeals from a judgment of the United States District Court for the Southern District of New York (Mark D. Fox, Magistrate Judge), granting summary judgment to defendant and dismissing plaintiffs claims of race and gender discrimination. The magistrate judge ruled that plaintiff had failed to establish a pri-ma facie case of race discrimination because she could not show that similarly situated employees had been treated differently with respect to severance pay.
