This was an action for damages for tbe conversion of four carloads of wheat. The answer was a general denial. The case was tried before the *499court sitting as a jury, and the trial resulted in a finding and judgment for the plaintiff. The defendant appeals and assigns for error: First, that the court erred in admitting evidence offered by the plaintiff; second, that the court erred in refusing instructions for a nonsuit offered by the defendant.
