Pending before the Court are: (a) Defendants’ ONE, Inc.’s, doing business as, The Wings Family, and José Amid Rodriguez’ Motion to Dismiss under FRCP 12(b)(6), filed on January 30, 2013, Docket No. 18, and (b) Response in Opposition to Defendants’ Motions to Dismiss under FRCP 12(b)(6) (DOC. 18), filed by plaintiffs on February 4, 2013, Docket No. 19. For the reasons set forth below, the defendants’ motion to dismiss is hereby granted in part and denied in part.
