RABINOWITZ, Chief Justice.

This appeal involves a dispute over a group of mining claims in Bachelor Creek. June Baird (Baird) filed suit against Tom Cornwall, asserting that she owns a 25% interest in the claims, requesting an accounting of the costs and income relating to the mining activities on the properties, and requesting her share of the proceeds. Baird moved for partial summary judgment on her claim that she is entitled to a 25% interest in the mining properties and proceeds.
