Pending before the Court is a petition filed by Petitioner Roberto Giampaolo (“Petitioner”) under The Hague Convention on the Civil Aspects of International Child Abduction and the International Child Abduction Remedies Act, 42 U.S.C. §§ 11601, et seq, for the return of his minor child to Argentina. On August 19, 2004, the Court conducted an evidentiary hearing in this matter and heard from both Petitioner and Respondent Evelina Erneta (“Respondent”).
