GARDNER, Circuit Judge.
This was an action brought by appellee .as plaintiff against appellant seeking a ■declaratory iudgment that his housing accommodations were decontrolled by the Housing and Rent Act of 1947 as amend ed, and for an injunction restraining appellant from establishing and enforcing maximum rentals thereon.
