This is an appeal on questions of law from a judgment of the Court of Common Pleas of Cuyahoga County.

Preston Howard and Lucille Howard brought an action as taxpayers of the City of Cleveland in the Court of Common Pleas to restrain the City, its Finance Director, and the Auditor of Cuyahoga County from enforcing a penalty provision of Ordinance 2428-58, Section 13.0722 of the Codified Ordinances of the *306City of Cleveland on the grounds that such ordinance was illegal and unconstitutional.
