This is an appeal from an order sustaining a demurrer to the complaint on the ground that it does not state facts sufficient to constitute a cause of action.
Plaintiff brings this action as a taxpayer. The complaint alleges: That on August 12, 1895, the city council of Duluth passed an ordinance calling a special election to be held on September 21, 1895, for the purpose of voting on the proposition of authorizing the city council to issue water and light bonds to buy or build a water plant for said city, and that the ballot authorized to be used, and which was so used, is in the following…
