In the May, 1924, term of the circuit court of Day • county, appellant was -tried and convicted upon an information charging murder, and was sentenced to life imprisonment in the state penitentiary. At the time of the homicide he was 38 years of age, marriedi, and had a family of five children. He and his wife were both Indians and he was a lay reader or preacher in the Indian Church near Enemy Swim.
