WOOD (W. J.), J.

In this action, for malicious prosecution, which was tried with a jury, plaintiff obtained a judg ment in the sum of $5,000 against Maurice Lee, Myrtle I. George, Raleigh George and Richard F. George. The motion of Richard F. George for a new trial was granted and- the motion of the other defendants for a new trial ''was denied upon the remittance by plaintiff of the sum of $2,000, which the court had required as a condition of the denial of the motion. Defendants Mjrrtle I. George and Raleigh George have appealed from the judgment. Defendant Lee has not appealed.
