Affirming.
On December 21, 1938, tbe board of directors of tbe Farmers State Bank, a corporation organized under tbe laws of Kentucky and conducting a banking business at London, Kentucky, placed the bank in tbe bands of the state banking commissioner for liquidation. On March 2, 1940, Arlie Magee was appointed special deputy banking commissioner to liquidate tbe affairs of tbe bank. Among tbe assets of tbe bank tbe commissioner found a note of $300, dated November 12, 1938, and due six months thereafter with interest at tbe rate of 6 per cent, per annum from…
