STANIFORTH, J.

Beverly Joyce Gibson appeals from that portion of a judgment granting petitioner Michael Lynn Griffith visitation rights with his son. The six-year-old Michael was born out of wedlock to these parties. These parents have never married; the father does not fulfill any of the conditions set forth in Civil Code section 7004 giving rise to the rebuttable presumption he is the natural father of Michael. 1

Both parents agree, however, Griffith is in fact the natural father. Griffith entered into agreement with the family support division of the district attorney’s office…
