THOMPSON, District Judge.

This case is before the Court on appeal from the decision of the District Court denying appellant’s motion to set aside the verdict of the jury and to enter judgment for appellant or to order a new trial on the single issue of damages or on all the issues. The appellant, personal representative of J. ,W. Bell, deceased, plaintiff in the trial court, and the appel-lee, Pennsylvania Railroad Company, defendant in the trial court, will be referred to herein as plaintiff and defendant, respectively.
