In this action the plaintiffs, who are taxpayers of the defendant city of Waterbury, sought an injunction ordering rescission of the purchase of certain real estate made by the city from the defendant Mattatuck Construction, Inc. (Mattatuck). The complaint alleged that the purchase of the land was illegal because certain procedural requirements for such an acquisition were not followed.
