These two defendants below William Ledger and William H. Plaggard were convicted of burglary and sen tenced to not more than three years in the penitentiary. Haggard was also charged and convicted nnder the Habitual Criminal Act.

The proof shows that the home of Mrs. Hazel Talley was broken into and a combination radio-phonograph and two electric irons were stolen. The burglar or burglars entered the house by prying a padlock’off the door.

'The State’s proof shows that- ibis breaking in and entering was between Friday .night and Sunday night, in September of 1954.
