Plaintiff in error was convicted of the crime .of burglary at the February term, 1895, of the Peoria circuit court, and sentenced to imprisonment in the penitentiary for the term of five years. He brings this record here for a review on writ of error.

Plaintiff in error was an unmarried man of about the age of thirty-two years, the son of respectable parents, with whom he lived in Peoria. Shortly after midnight of the 8th of May, 1894, he was discovered in the dwelling house of Mrs. Bell, located almost directly across the street from his parents’ home.
