Plaintiff, as the owner and holder of certain school certificates, sued the Orleans parish school board to recover the sum of $8,934.36 with legal interest thereon from judicial demand. The certificates in question were issued under the provisions of Act No. 36 of 1873 for unpaid salaries of teachers and, other expenses of maintaining the public schools of the parish of Orleans during the years 1874, 1875, and 1876.

Defendant excepted to plaintiff’s petition as disclosing no cause of action, and also pleaded the prescription of 3, 5, and 10 years to plaintiff’s demand. The district judge…
