Appellee Hurd and the appellant, the town of Sterling, entered into a contract whereby the former agreed to construct a system of water works for the *437purpose of supplying the inhabitants of the town with water for • domestic, fire and other purposes. Hurd was to furnish all the materials and perform all the work necessary to complete the system. The contract contemplated the building of a reservoir, the construction of a wooden pipeline about six miles in length, a distributing system within the corporate limits of the town, and the installation of an auxiliary fire pump for the purpose of…
