WALLACE, Circuit Judge.

This is a writ of error by the plaintiff in the court below to- review a judgment for the defendants entered «pon a verdict rendered by the direction of the court. 108 Fed. 502.

The action was brought to recover damages sustained by the United 'States for a breach of a contract for the construction of a dry dock at the navy yard, Brooklyn, N. Y., made May 8, 1895, to which contract the defendants Thomas and Augustin Walsh, as principals (named therein as “contractor”), and the defendant Crimmins, as surety, were parties of the first part, and the bureau of yards and…
