—Proceeding pursuant to CPLR article 78 to review a determination of the respondent Commissioner of the Department of Public Works of the City of White Plains, dated July 23, 1998, which adopted *354the findings and recommendation of a hearing officer, made after a hearing, finding the petitioner guilty of misconduct and dismissing him from employment.

Adjudged that the determination is confirmed and the proceeding is dismissed on the merits, with costs.
