This is an action to recover damages for false arrest and imprisonment and malicious prosecution. Plaintiff appeals from an order of the circuit court dismissing the second count in her declaration, alleging malicious prosecution.

Plaintiff Clara Roblyer, is a widow approximately 60 years of age, who has resided in a small 1-family dwelling house in the city of Kalamazoo for some 22 years.
