Plaintiffs Broadway 41st Street Realty Corporation (“Broadway 41st”) and Rosen-thal & Rosenthal Inc. (“Rosenthal”) brought suit for damages and injunctive relief against certain public and private entities engaged in the 42nd Street Development Project (the “Project”).
